CMS to Consider 2012 Life Safety Code in Upcoming Proposal

The Centers for Medicare & Medicaid Services (CMS) says it will use an upcoming rulemaking process to consider whether the agency should make compliance with the latest edition of NFPA 101: Life Safety CodeĀ® part of Conditions of Participation (CoPs) for hospitals and critical access hospitals. CMS recently solicited comments about whether the agency should adopt the 2012 edition instead of the 2000 edition currently required for Medicare and Medicaid reimbursements. ASHE encouraged CMS to adopt the newest version, which will save hospital resources and present fewer instances of conflicting codes. CMS said in its final regulation to revise CoPs that it appreciated the comments and would consider the issue through separate notice-and-comment rulemaking in a rule targeted for publication in the near future. CMS said that many commenters recommended adopting the 2012 edition, and many also suggested that CMS should simply require the most current edition instead of adopting a specific edition and then having to update it later. CMS’s response on this issue can be found it its final regulation (see pages 113-114). ASHE will keep members updated on the latest developments with this issue.

The Centers for Medicare and Medicaid Services (CMS) revised its rules on preventive maintenance schedules for medical equipment in December. The change requires hospitals to comply with manufacturers' recommended schedules for preventive maintenance on certain pieces of equipment even though manufacturer recommendations are not necessarily based on scientific data and many hospitals have developed their own schedules based on data. Now ASHE is asking its members for input on this developing issue in the form of two surveys developed by the Joint Commission -one on clinical equipment and another on facilities equipment-and ASHE professional active members with responsibility for clinical or facility equipment should take the appropriate survey. Those responsible for both clinical and facilities equipment should take both surveys.
